United Pacific Industries, Inc. (“UPI”) recognizes that privacy is important, and we are committed to transparency on how we collect and use any information.  This Privacy Policy describes how your personal information is collected, used, and shared when you visit or use the services provides at www.UPcarparts.com (the “Site”).  This Privacy Policy specifically addresses requirements from the California Consumer Privacy Act of 2018 (CCPA), which takes effect on January 1, 2020, and other California privacy laws.  Please read the information below to learn the following regarding your use of this Site:
This Privacy Policy is part of our Site Terms of Use, and by accessing or using this Site, you agree to be bound by all of its terms and conditions.  If you do not agree to these terms, please do not access or use this Site.

We reserve the right to change this Privacy Policy at any time.  If we make material changes to this Privacy Policy, we will notify you through a notice on this Site’s home page.  The date this Privacy Policy was last revised is identified at the top of the page.  You are responsible for periodically visiting our Site and this Privacy Policy to check for any changes.  Your continued use of the site after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by the modified Policy.

1. What information do we collect from you?
In order to better provide you with our numerous services, we collect two types of information about our users: Personally Identifiable Information and Non-Personally Identifiable Information.  When we talk about “Personal Information” in this Privacy Policy, we are talking both about Our Personally Identifiable Information and Non-Personally Identifiable Information.  Our primary goal in collecting Personal Information from you is to provide you with a smooth, efficient, and customized experience while using this Site.

Personally Identifiable Information: This refers to information that lets us know the specifics of who you are.  When you engage in certain activities on this Site, such as registering for a membership, ordering a product or service, submitting content and/or posting content in discussion forums or other public areas, entering a contest or sweepstakes, filling out a survey, or sending us feedback, we may ask you to provide certain information about yourself by filling out and submitting an online form.  It is completely optional for you to engage in these activities.  If you elect to engage in these activities, however, we may ask that you provide us information, such as your first and last name, mailing address (including zip code), e-mail address, employer, job title and department, telephone and facsimile numbers, and other personal information.  When ordering products or services on the site, you may be asked to provide a credit card number.  Depending upon the activity, some of the information we ask you to provide is identified as mandatory and some as voluntary.  If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

Non-Personally Identifiable Information: This refers to information that does not by itself identify a specific individual.  We gather certain information about you based upon where you visit on our site in several ways.  This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the Uniform Resource Locator (“URL”) that you used, which URL you go to next, what browser you are using, and your Internet Protocol (“IP”) address.  An URL is the global address of documents and other resources on the World Wide Web.  An IP address is an identifier for a computer or device on a Transmission Control Protocol/Internet Protocol (“TCP/IP”) network, such as the World Wide Web. Networks like the Web use the TCP/IP protocol to route information based on the IP address of the destination.  In other words, an IP address is a number that is automatically assigned to your computer whenever you are surfing the web, allowing web servers to locate and identify your computer.  Computers require IP addresses in order for users to communicate on the Internet.

UPI has collected the following categories of personal information from California’s residents within the last twelve (12) months:

  • Identifiers (e.g., name, username, IP address, email address, etc.)
  • California Customer Records Statute (e.g. name, signature, social security number, etc.
  • Characteristics of protected classifications under California or federal law (e.g. race, national origin, gender, etc.)
  • Commercial information (e.g. records of personal property, purchases, etc.)
  • Biometric information
  • Internet or other electronic network activity information (e.g., browsing history, search history, etc.);
  • Geolocation data
  • Audio, electronic, visual, thermal, olfactory, or similar information
  • Professional or employment-related information
  • Education information, as defined in the Family Educational Rights and Privacy Act
  • Inferences drawn from personal information to create a profile about a consumer

2. Where do we collect information from you and how do we use it?
We do not collect any Personally Identifiable Information about you unless you voluntarily provide it to us.  You provide certain Personally Identifiable Information to us when you:

  • Register for our services and register your e-mail address with us;
  • Enter sweepstakes or contests sponsored by us or one of our partners;
  • Sign up for special offers from selected third parties;
  • Send e-mail messages, submit forms or transmit other information by telephone or letter; or
  • Submit your credit card or other payment information when ordering and purchasing products and services on our site.

We may also collect information from you at other points on our site that state that such information is being collected. In addition, we may also collect, or our third party ad server and/or content server may collect, certain Non-Personally Identifiable Information.  This information is ultimately stored in the form of store categories, and, in some cases, specific URLs.  We use your IP address to diagnose problems with our servers, software, to administer our site and to gather demographic information.  Our third party ad servers will also provide us with summary, but not individual, reports that will tell us how many ads were presented and clicked upon at our site.

We primarily use your Personally Identifiable Information to provide our services to you, as required by our agreements with you.  We also use Personally Identifiable Information to enhance the operation of our site, fill orders, improve our marketing and promotional efforts, statistically analyze site use, improve our product and service offerings, and customize our site’s content, layout, and services.  We may use Personally Identifiable Information to deliver information to you and to contact you regarding administrative notices. We may also use Personally Identifiable Information to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Site Terms of Use, Sales Terms and Conditions, and this Private Policy.

We may, from time to time, send you e-mail regarding our products and services.  In addition, if you indicated upon registration that you are interested in receiving offers or information from us and our partners, we may occasionally send you direct mail about products and services that we feel may be of interest to you.  Only UPI (or agents working on behalf of UPI and under confidentiality agreements) will send you these direct mailings and only if you indicated that you do not object to these offers.  If you do not want to receive such mailings, simply tell us when you give us your personal information.  Or, at any time you can easily edit your account information to no longer receive such offers and mailings.  Additionally, you can click on the opt-out link on the bottom of any electronically generated communication from UPI, or at any time by contacting us at below.

3. With whom do we share your information?
We do not sell, trade, or rent your Personally Identifiable Information to others.  We do provide some of our services through contractual arrangements with affiliates, services providers, partners and other third parties.  We and our service partners use your Personal Information to operate our Sites and to deliver our services.  For example, we use third party payment processors like Solupay, Braintree and Paypal to process your credit card information.  We release your address to delivery companies to deliver products that you ordered; and provide order information to third parties that help us provide customer service.  We may also provide Non-Personally Identifiable Information about our customers’ sales, traffic patterns, and related site information to third party advertisers, but these statistics do not include any Personally Identifiable Information.

We encourage our service partners to adopt and post privacy policies. However, the use of your Personal Information by our service partners is governed by the privacy policies of those service partners, and is not subject to our control. Occasionally we may be required by law enforcement or judicial authorities to provide Personal Information to the appropriate governmental authorities.  We will disclose Personal Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation.  We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.
When we disclose your personal information for a business purpose, we enter a contract that describes the purpose and require the recipient to both keep the personal information confidential and not use it for any purpose except performing the contract.  In the preceding twelve (12) months, we have disclosed the following categories of personal information for a business purpose to third party:

  • Identifiers (e.g., name, username, IP address, email address, etc.)

4. How can you update or amend your Personally Identifiable Information?We believe you should have the ability to access and amend the Personally Identifiable Information that you have provided to us.  You may change any of your Personally Identifiable Information in your account online at any time by linking to your account in accordance with instructions posted elsewhere on this site.  You may also update your Personally Identifiable Information by contacting us at below.

We encourage you to promptly update your Personally Identifiable Information if it changes.  You may ask to have the information on your account deleted or removed; however, because we keep track of past transactions, you cannot delete information associated with past transactions on this site.

5. What rights you have under CCPA?
California residents have the following rights under CCPA:

  • The right to know what Personal Information is being collected about you.
  • The right to know whether your Personal Information is sold or disclosed and to whom.
  • The right to say no to the sale of Personal Information.
  • The right to access your Personal Information.
  • The right, in certain circumstances, to delete the information you have provided to us.
  • The right to equal service and price, even if you exercise your rights.

Right to Access.You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months.  Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • The categories of personal information and specific pieces of information that we sold, disclosed, purchased or obtained.

Right to Delete.You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction that you requested.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Non-Discrimination. We will not discriminate against you for exercising any of your consumer’s rights.  Unless required by applicable law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

To exercise your consumer’s rights, the access, please submit a verifiable consumer request to us by sending us a message on our website.  Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period.  The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
  • We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. 

6. What security precautions are in place to protect against the loss, misuse, or alteration of your information?
At our Site you can be assured that your Personal Information is secure, consistent with current industry standards.  The importance of security for all Personal Information associated with our user is of utmost concern to us.

Your Personally Identifiable Information is protected in several ways.  Access by you to your Personally Identifiable Information is available through a password and unique customer ID selected by you.  This password is encrypted.  We recommend that you do not divulge your password to anyone.  In addition, your Personally Identifiable Information resides on a secure server that only selected UPI personnel and contractors have access to via password.  We encrypt your Personally Identifiable Information and thereby prevent unauthorized parties from viewing such information when it is transmitted to us.

Non-Personally Identifiable information about you is stored in a secure server and can only accessible via password.  Since this information is not accessible from outside of UPI, you will not be asked to select a password.  You may request us to delete the non-Personally Identifiable information about you, but you are not allowed to modify such information.

In order to most efficiently serve you, credit card transactions and order fulfillment are handled by established third party banking, processing agents and distribution institutions. They receive the information needed to verify and authorize your credit card or other payment information and to process and ship your order. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure.  As a result, while we strive to protect your Personally Identifiable Information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.


7. Do we use “cookies”?
When you use our Site, we will store cookies on your computer in order to facilitate and customize your use of our Site.  A cookie is a small data text file, which a Web site stores on your computer’s hard drive (if your Web browser permits) that can later be retrieved to identify you to us.  Our cookies store randomly assigned user identification numbers, the country where you are located, and your first name to welcome you back to our Site.  The cookies make your use of the Site easier, make the Site run more smoothly and help us to maintain a secure Site.  You are always free to decline our cookies if your browser permits, but some parts of our Site may not work properly in that case.

We may use an outside ad serving company to display banner advertisements on our Site.  As part of their service, they will place a separate cookie on your computer.  We will not provide any third-party ad server with any of your Personally Identifiable Information or information about your purchases.  We and our third party ad server will collect and use Non-Personally Identifiable Information about you, such as your IP address, browser type, the server your computer is logged onto, the area code and zip code associated with your server and whether you responded to a particular ad.  Other advertisers may also place banner ads on our site in the same manner as above, but we will not disclose any Personally Identifiable Information to them.

Do Not Track (DNT) Setting: DNT is a privacy preference that users can set in certain web browsers.  DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services.  Please note that we do not respond to browser DNT signals.  We do not alter our Site’s data collection and practices when we see a DNT signal from your browser.


8. What should you know about privacy policies and data collection at any third party sites accessible from our Site?
Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you.  Other sites accessible through our Site have their own privacy policies and data collection, use and disclosure practices.  Please consult each site’s privacy policy.  We are not responsible for the policies or practices of third parties.  Additionally, other companies which place advertising on our site may collect information about you when you view or click on their advertising through the use of cookies.  We cannot control this collection of information.  You should contact these advertisers directly if you have any questions about their use of the information that they collect.


9. What else should you know about your privacy online?
We do not provide services or sell products to children under the age of 18.  By accessing this Site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use and have access to this Site.

If you are under 16, please do not use or provide any information on this Site.  If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information.  If you believe we might have any information from or about a child under 16, please contact us at the email address below.

We do not knowingly collect personal information from children under 13.  If you become aware that a child has provided us with personal information, please contact us using the contact information below.  If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information.

You should also be aware that when Personally Identifiable Information is voluntarily disclosed (i.e. your name, e-mail address, etc.) in the discussion forums or other public areas on this Site, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages from third parties.  Such activities are beyond our control and this Policy does not apply to such information.  Any submissions to chat rooms or other public areas on this site are accepted with the understanding that they are accessible to all third parties.  If you do not want your comments to be viewed by third parties, you are advised not to make any submissions. Ultimately, you are solely responsible for maintaining the secrecy of your password and/or account information.  Please be careful and responsible whenever you’re online.

10.  How about international transfer of data?
This Site is intended for consumers in the United States of America.  Any data that you provide to us may be accessed, shared or processed by our offices, located in the United States of America, and service providers located in the United States of America, if such data transfer is necessary for the specific purpose for which you submitted your data (such as the provision of goods or services under a written contract).
Use of this Site may entail a transfer of your personal information across international borders. The data protections standards may differ and be lower than the standards enforced in your jurisdiction.  By using this Site, you consent to the transfer of all such information to the United States of America which may not offer an equivalent level of protection to that required in the European Union and to the processing of that information by UPI and its servers located in the United States of America as described in this Privacy Policy.  We maintain appropriate safeguards as required by applicable law for any personal information transferred internationally.
